Gorm Media DAC (“GORM,” “we,” “us,” or “our”) is an independent organisation.

By browsing the public areas or accessing and using the Websites, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use and our Privacy Policy, which is hereby incorporated by reference (collectively, this “Agreement”). If you do not agree to any of these terms, please refrain from using the Websites.

Any user who registers with us (each, a “Registered User”) and intends to purchase a product or service through one of our Websites agrees to the terms of this Agreement and the accompanying Terms and Conditions of Purchase for such product or service. In case of any conflict between the terms of this Agreement and the Terms and Conditions of Purchase, the latter shall prevail.

1. Description and Use of Our Websites

We offer Visitors, Registered Members to the Services as described below:

Visitors: Visitors can explore the Websites without registering. They can view all publicly-available content and contact us via email.

Registered Member: Registered Users can do everything Visitors can, plus: purchase products and services, access exclusive content, manage personal accounts, post comments, sign up for programs, alerts, and become part of the GORM community.

GORM reserves the right to accept or reject any registration and may deactivate any account if it violates these Terms of Use.

2. Community Guidelines

GORM thrives when users follow simple rules:

  • Compliance with applicable laws.

  • Respect for others' rights and privacy.

  • Avoidance of spam and commercial activities.

  • Relevant posting and avoidance of off-topic content.

  • No impersonation or misuse of the Websites.

  • No interference with the Websites' operations.

  • Reporting inappropriate content.

We reserve the right to deny access or remove content that violates these guidelines.

3. Restrictions

The Websites are available only to individuals aged 13 years or older. If under 13 or under the age of majority, review this Agreement with a parent or guardian.

4. Sign-In Name; Password; Unique Identifiers

Registered Members create accounts with a sign-in name (“Sign-In Name”), password (“Password”), and additional identifying information. Sharing access credentials is prohibited.

5. Fees and Payment

By making purchases on the Websites, you agree to pay all applicable fees and taxes. Payment is authorised upon purchase. Fees and payment terms are detailed in the Terms and Conditions of Purchase.

6. Intellectual Property

The Websites' Content is protected by law. Visitors may view publicly-available Content for personal, non-commercial use. Registered Members may download Content for personal, non-commercial use. Unauthorised use of Content is prohibited.

7. Registered Member Content; Licenses

Registered Members can post and upload content (“Registered Member Content”). By submitting Registered Member Content, you grant us a license to use, modify, and distribute it.

8. Unsolicited Submissions; Communications With Us

We do not accept unsolicited submissions. Any such submissions will not create a confidential or proprietary relationship. Feedback and questions are welcomed but become our property upon submission.

9. No Warranties; Limitation of Liability

We provide the Websites and Content “as is,” without warranties. We are not liable for damages, except for direct damages limited to fees paid within the preceding three months.

10. External Sites

We provide links to External Sites for convenience. We are not responsible for their content or accuracy.

11. Representations; Warranties; and Indemnification

Registered Members represent that their content complies with this Agreement and agree to indemnify us against any claims arising from their breach.

12. Compliance With Applicable Laws

You are responsible for compliance with your jurisdiction's laws when accessing the Websites.

13. Termination of the Agreement

We may terminate or suspend access to the Websites at any time without notice. Certain sections of this Agreement shall survive termination.

14. Digital Millennium Copyright Act

We respect intellectual property rights. If you believe your copyright has been infringed, please contact us.

15. Controlling Law

This Agreement is governed by the laws of the Republic of Ireland.

16. Binding Arbitration

Disputes shall be resolved through binding arbitration. Class action lawsuits are prohibited.

17. Class Action Waiver

Disputes must be resolved on an individual basis; class actions are not permitted.

18. Equitable Relief

We may seek injunctive relief for breaches of intellectual property rights.

19. Miscellaneous

This Agreement constitutes the entire agreement between you and us and supersedes any previous agreements.
